What You Need to Know:
We love running promotions for you guys and we want to be as clear as possible on how you enter, and how the prize is drawn. Please read the nuts and bolts below for the full details.
1. We know that there are ASOS lovers all around the world, but this promotion is only open to residents of the UK aged 18 or over. So that we are completely fair, anyone employed by us or professionally connected to this promotion is not allowed to enter.
2. You don’t have to buy anything to take part in this promotion, but you do need your own active TikTok account, email account and access to the internet in order to enter.
3. Promotion Period: You can enter between 10:00 BST on the 26 September 2022 and 23:59 BST on the 28 September 2022.
4. To Enter: Entering this promotion is simple just log onto your Instagram account (or create one for free), follow @asos and create a video of the outfit that you would wear to the FONO gig, post the video to your Instagram grid, and include the hashtag #ASOSxFONO to enter the prize draw.
5. You must keep your profile on a public setting and continue to follow the @asos account for 4 weeks after the end of the Promotion Period in order to be contacted if you are selected as a winner.
6. We’re sorry, but a maximum of 1 entry is permitted per person per day during the Promotion Period. No person may win more than 1 Prize.
7. The Prize There will be a total of 8 winners. Each winner will win 1 x pair of tickets to the FONO gig at the Union Chapel, 19b Compton Terrace, London N1 2UN (the “Venue”) on 11 October 2022 at XX (the “Event”).
8. Further Entry Details and Conditions:
a. Make sure that you get consent from anyone in the video before you enter the Promotion.
b. Just make sure you don't include any content that infringes or violates the rights of any third party, including but not limited to, ownership, copyrights, trademarks, patents, logos, licensing rights, rights of publicity or privacy or any other intellectual property rights, excluding that of ASOS.
c. Remember, when you enter, you must only submit video that are your own work.
d. We will reject entries which, in our reasonable opinion have been submitted previously in a promotion of any kind or exhibited or displayed publicly.
e. We will reject entries which, in our reasonable opinion include the names, likenesses, photographs, or similar of any individual without their express permission.
f. You irrevocably and unconditionally assign to us with full title guarantee (and by way of present assignment of present and future rights) all intellectual property rights in any “Footage” throughout the world for the full unexpired period of such rights and all renewals, reversions and extensions of such period as may be provided under any applicable law throughout the world.
9. Further Prize Details and Conditions:
a. Claiming your Prize
i. The Promoter will provide a single-use link to winners for an online ticket portal, from which the winner(s) can download their Prize.
ii. Winners must claim their Prize within 2 days of being notified. After this length of time the single-use link will expire and the Prize may be awarded to another entrant, selected at random.
iii. When downloading your Prize, you will need to give your full-name and this will be displayed on the ticket(s). You will need to arrive with valid, in-date photo ID matching this name in order to gain access to the Venue.
iv. The online ticket portal is managed by Gigantic Tickets Limited on behalf of For One Night Only (a trading name of HTYT Limited) (“FONO”). All personal data collected will be held legally and in accordance with the relevant FONO privacy policy and/or Gigantic Tickets Limited’s Privacy Policy (https://www.gigantic.com/privacy-policy), as applicable.
b. Conditions of Venue entry
i. Prizes are strictly non-transferable, non-refundable and not for resale. If you cannot attend the Venue on the date of the Event, please let the Promoter know and it will award the Prize to another entrant, selected at random.
ii. STRICTLY NO RECORDING EQUIPMENT (including mobile phones): The Performer may be performing unreleased or otherwise sensitive or confidential content. As such, the Event operates a strict no recording equipment policy. The unauthorised use of photographic and recording equipment at the Event is prohibited. Mobile phones with cameras, as well as stand-alone cameras, tape recorders or other recording equipment are not permitted at the Event and may be confiscated for the duration of the Event. The Venue and/or Event organisers may require and provide facilities for you to surrender your mobile phone and/or make your mobile phone inaccessible for the duration of the Event (for example, without limitation, the Event organiser may require mobile phones by placed in sealed pouches for the duration of the Event). If you refuse to comply with such a request, you may be refused entry without compensation. It is strictly your responsibility to keep your property secure and collect and/or unseal your property after the Event. It is strictly your responsibility to return any hardware provided to you to in the manner instructed during and/or after the Event. Neither the Venue nor the Promoter takes any responsibility or liability for any personal property that is held on your behalf or confiscated under the terms of this paragraph.
iii. In order to attend the Event, winners are required to:
1. present valid, in-date photo ID at the venue matching the name of the winner that is displayed on your Prize (i.e., your tickets). Failure to do so will result in access to the Venue being denied; and
2. sure that anyone under the age of 16 at the time of the event is accompanied by the winner, being an adult of age 18 or over.
iv. You acknowledge that the Prize is subject to the terms and conditions of the Venue, the Promoter and any relevant ticket agent or other such third party and you must comply with all such terms and conditions, including but not limited to any relevant instructions and health and safety requirements.
v. More information about the Venue, including the Venue’s terms and conditions and FAQs, can be found on the Venue’s website, including: https://unionchapel.org.uk/venue/your-visit. Please check the Venue’s terms and conditions for full information about their conditions of entry.
vi. The Promoter and the Venue reserves the right to perform background checks on winners for security purposes, and where necessary your information may also be shared with other parties involved in the Event (for example, without limitation, the Event organisers, the Performer’s management or the Venue’s management) should they wish to run background checks (only where it is legal, proportionate and appropriate to do so). The Promoter and the Event organisers reserve the right, at their discretion, to disqualify Prize winners based on the findings of these checks.
c. Venue accessibility
i. Should you win one of the Prizes, attendance at the Event is at your own risk. If the Prize requires that you undertake physical activity please ensure, before entering the Prize Draw, that you are in good health, that you have informed us at the time of claiming the Prize of any underlying medical condition, physical or other impairment or medication you are taking which may be relevant and which could adversely affect your use or enjoyment of the Prize, or ability to claim the Prize.
ii. If, as a winner, you require accessible seating at the Event you will be able to choose this option when claiming your Prize. Additional information can be found on the Venue’s website: https://unionchapel.org.uk/accessibility.
iii. The Promoter will work with the Venue and selected third parties to create the best possible experience for disabled guests, making all reasonable accommodations.
iv. The Promoter will work with the Venue and selected third parties to endeavour to maximize the number of accessible tickets that are available to winners, if the make-up of winners requires such accommodations. However, the number of accessible tickets that are available may be capped according to the Venue’s requirements, which are beyond the Promoter’s control. As such, accessible tickets are subject to availability.
v. If you require accessible seating but find that none are available when claiming your Prize, we regret that this means the Venue’s limit for accessible seating has already been met. Please contact the Promoter via email [INSERT CONTACT DETAILS] and we will do what we can to help. However, if the Venue’s accessible seating capacity has already been met, we will unfortunately be unable to offer a Prize.
vi. You are encouraged to contact the Promoter as early as possible upon winning a Prize with any accessibility requirements, so that the Promoter has the greatest opportunity to assist you. In any event, you must inform the Promoter of any specific accessibility requirements by contacting via email [INSERT CONTACT DETAILS] at least [INSERT TIME PERIOD, TO BE CONFIRMED BY VENUE] before the Event.
d. Additional important information
i. In relation to winners and their guests (and runners up if applicable), you understand that the Promoter and/or the Venue and/or the Performer and/or the Event organiser or other relevant third parties may film, photograph and/or record you and your guest during or in connection with the Event and may use such films, recordings and/or photographs for publicity and PR purposes in any and all media, worldwide, as often and for as long as desirable. The Promoter and/or the Venue and/or the Performer and/or the Event organiser or other relevant third parties may also publish your and your guest’s name, image, social media handle and/or profile picture.
ii. By entering the Prize Draw, you grant us, the Event organiser and any relevant third party suppliers a worldwide, royalty-free, perpetual and Irrevocable licence (i.e. permission) to use your entry into the Prize Draw and/or other materials in relation to the Prize Draw that you provide to us or are featured in (including, without limitation, as part of the entry process or as part of a prize or if you tag or mention us directly or indirectly in any photo, video or other content), as often and for as long as is appropriate or desirable. You waive and agree not to assert your so-called moral rights and equivalent rights (for example, without limitation, the right to be named or credited) in relation to the same throughout the world, forever.
iii. The Promoter cannot guarantee that the services or systems for entering the Prize Draw or claiming a Prize will be free from omissions, errors, viruses, bugs or otherwise be fully available.
iv. You agree that you have not done anything and will not do anything which is likely to bring us or any of our third party partners into disrepute or which might adversely affect our, the Performer’s, the Event organiser’s or our partner’s reputation or the Prize Draw.
v. Nothing in these terms limits or excludes our (or any third party’s) liability arising from fraud or from death or personal injury caused by negligence or any other type of liability which may not be limited or excluded by law.
vi. Subject to paragraph 4.5, to the fullest extent permissible by law, we and any of partners or suppliers:
1. shall have no liability in relation to any act or omission of any other third party; and
2. exclude all liability to you and anyone else for any claims, costs, losses, including indirect loss, damage or harm of any kind arising from or in connection with the Prize Draw and Prize and your use or enjoyment of them. For example (without limitation) if you book or take time off work with the intention of attending the Event, and the Event is subsequently postponed, changed or cancelled, we would not be responsible for covering your wages or salary for your missed day of work on that day or any other day off you take.
vii. Subject to paragraph 4.5, to the fullest extent permissible by law, in no event will our or any third party’s total aggregate liability to you exceed the cost of the Prize if you are a winner, or otherwise the cost of entry into the Prize Draw.
viii. We make no representation, warranty or guarantee in relation to the Prizes provided and, subject to paragraph 4.5 and statutory rights which cannot lawfully be waived, we will have no liability to you in relation to any Prize, its fitness for purpose or otherwise.
e. COVID-19
i. You acknowledge and agree that, without limitation, the Promoter’s ability to fulfil a Prize and/or perform any of its obligations under these terms could be affected by an actual or threatened epidemic, pandemic, disease or quarantine and/or any corresponding governmental action, guidance and/or ruling (including but not limited to any Foreign, Commonwealth & Development Office guidance) (“Covid Measures”).
ii. If, due to any Covid Measures, the Promoter is unable to fulfil a Prize or perform any of its other obligations under these terms, then the Promoter (and any relevant third party) shall not be in breach of these terms nor responsible for any expenditure, losses or costs incurred by you.
a) For the avoidance of doubt, the Prize doesn't include travel/transportation, accommodation, food, beverages, souvenirs, gratuities, car parking charges, or any other costs of a personal nature (including spending money) that are not explicitly set out in these Terms and Conditions and neither we or any provider of any part of the Prize will be responsible for these costs.
10. Winner Selection: So that you know we’ve selected our winners fairly from all the valid entries we receive, the random draw will be carried out by PromoVeritas, the independent promotional verification service to select 2 provisional winners. The draw will take place within 2 working days of the end of the Promotion Period.
11. Contacting the Winners: We’ll contact the provisional winners via the social media account used to enter within 2 working days of Winner Selection and will be asked to provide evidence of identity and eligibility. Reasonable efforts will be made to contact the winners. Once eligibility has been confirmed, the provisional winners will be confirmed as a winner. If the provisional winners do not respond to the initial contact within 2 days, we reserve the right to disqualify that entrant and award the Prize to a reserve selected in the same manner. Reserve winners may have less time to respond.
12. Prize Acceptance: If you are our lucky winners, notification to arrange fulfilment of the Prize will take place within 2 days of acceptance of the Prize. In the unlikely event that the winner has not received communication to arrange their Prize, the winner must inform us by emailing XXXX. If you don’t let us know within this time frame, we will reserve the right to not reissue the Prize or limit its value at our sole discretion.
12. Moderation: We can’t accept any entries which we think:
a. Contain any content that is likely to be considered offensive by us or could reflect negatively the name, reputation, or goodwill of [insert brand] or any brand partner;
b. Include trademarks, logos, or copyrighted material not owned by you or used without the right holder's prior written permission (including famous names, company names, etc.);
c. Defames, misrepresents, or insult other people or companies, including, but not limited to [insert brand] (including its partners); or
d. Promotes any political agenda.
13. Provided no objection from the winners is received, we’ll make a winners list stating the surname and county of residence of the winners available 4 weeks after the close of the Promotion Period, for a period of 8 weeks. It will be available by sending a request via email to win@asos.com. Winners can object to their surname or county of residence being published or request for the amount of information being published to be reduced during the Winner Notification process. However, without prejudice, we will provide winner information to the Advertising Standards Authority on reasonable request.
14. Sorry, but you can’t transfer the Prize to someone else or exchange it for a cash alternative.
15. If, for reasons we can’t control, the Prize is no longer available, we’ll offer you an alternative Prize which we hope you’ll still love but which will definitely be of equal or greater value.
The Legal and Other Bits
No one likes the small print, but we need to let you know about some other important stuff too and make you feel comfortable that we run our promotions properly, fairly (and legally!):
16. Data Privacy: We care a lot about the security of your personal data and it will be held in accordance with our Privacy Policy here: www.asos.com/privacy-policy/ and will only be used for the purposes of this promotion save where you have opted in to receive communications from [JS13252]. We will only share your data with our Fulfilment Partners for the to fulfil this promotion.
17. The Promoter may request that the winners participate in reasonable publicity arising from the Promotion. Participation is at the winner’s discretion and is not a condition of Prize Acceptance.
18. We seek to run a fair and secure promotions and prevent abuse and cheating. If you enter in a way that is not consistent with these Terms & Conditions, your entries (and any of your associated aliases) will be disqualified, any Prize awarded may be void and recoverable, and we reserve the right to bar you from entering future promotions of ours for a period of at least six months. For this reason, we reserve the right at any point to:
a. Verify the eligibility of entrants and/or provisional winners by requesting such information we consider reasonably necessary for this purpose. Entry or a Prize may be withheld unless and until verification is completed satisfactorily.
b. Disqualify entries that are not made directly by the individual entering the Promotion.
c. Disqualify entries made using anonymous email services such as, but not limited to, GuerillaMail, Dispostable or Mailinator.
d. Disqualify bulk entries from individuals, trade, consumer groups or third parties, incomplete entries and entries submitted by macros or other automated means.
e. Disqualify entries beyond the maximum allowed, or those using techniques such as ‘script’, ‘brute force’, multiple SIM cards for Text entries, masking identity by manipulating IP addresses, using aliases or identities other than their own or any other means.
f. Disqualify entrants who tamper with the entry process.
g. Disqualify entries which, in some other way, do not fully meet the requirements of these Terms & Conditions.
h. Cancel, modify or suspend the Promotion should it not be capable of running as planned for reasons including but not limited to tampering, unauthorised intervention, fraud, dishonesty, technical failures, or any other causes beyond the control of the Promoter which corrupt or affect the administration, security, fairness, integrity or proper conduct of this Promotion.
19. No responsibility can be taken for entries which are lost, delayed, corrupted, damaged, misdirected or incomplete or which cannot be delivered for any technical, delivery or other reason. Proof of sending will not be accepted as proof of receipt. We can’t guarantee continuous or secure access to TikTok.
20. This Promotion is in no way sponsored, endorsed or administered by, or associated with TikTok. You are providing your information to the Promoter and not to TikTok, and TikTok is not responsible for any element of this Promotion.
21. We and our associated agencies and companies are not liable for any loss (including, without limitation, indirect, special or consequential loss or loss of profits), expense or damage which is suffered or sustained (whether or not arising from any person’s negligence) in connection with this Promotion or accepting or using the/a Prize(s), except for any liability which cannot be excluded by law. Nothing will exclude the Promotor’s liability for death or personal injury as a result of its negligence.
22. We won’t be liable for any delay or failure to comply with its obligations for reasons beyond its reasonable control arising from but not limited to Acts of God, global or regional epidemic or pandemic, adverse weather conditions, fire, industrial dispute, war, terrorist activity, hostilities, political unrest, riots, civil commotion, plague or other natural calamities, or any other circumstances.
23. If any part/s of these Terms & Conditions are legally ruled to be invalid, illegal or unenforceable, the remainder will not be affected and will continue in full force and effect.
24. By entering, you will be deemed to have agreed to be bound by these Terms & Conditions.
25. If there is a discrepancy between these Terms & Conditions and those in any promotional material, these Terms & Conditions will prevail.
26. These Terms & Conditions are governed by English law and their interpretation and application will be subject to the exclusive jurisdiction of the courts of England and Wales.
