ASOS #ASSEENONME TERMS AND CONDITIONS

How do I upload photos to the #ASSEENONME gallery?

ASOS love it when you take and share photos of yourself wearing your favourite ASOS outfits (“Photos”), and now your Photos could feature in ASOS’ #AsSeenOnMe gallery (the “Gallery”).  The Gallery is a great way to see, share and search amazing ASOS looks!

The Gallery is available on the sites listed below (including any version created for access via a mobile phone or other device and any associated websites, sub-domains, application or platforms that ASOS currently provide or make available in the future, (collectively the “Websites”):

There are 2 easy ways to upload your Photos for possible selection to the Gallery:

1) Either upload directly via Twitter or Instagram by using the hashtags #AsSeenOnMe or #ASOM (the “Hashtags”) alongside your Photo.  We’re able to find the photos by searching for the Hashtags so make sure your profile is public so we can find them!

2) Alternatively, depending on your country of residence, go to the applicable gallery URL above click ‘ADD LOOK’ and then follow the steps to upload your Photo.  It’s really easy.  All you need to do is click ‘Add an ASOS Look’ by either: uploading an existing photo from your desktop or mobile device or, alternatively, select the option to upload a Photo from your existing Instagram or Facebook account.  If you upload a photo directly to the Gallery at the links above you also get the added functionality of being able to ‘Add Items’ to tell us which items you’re wearing (up to a maximum of 6).  You can do this by typing a description of the item into the search bar at Step 2 and then selecting product images from the search results.  If you can’t find the exact item then you can select something similar instead.  You can also ‘Add Tags’ meaning you add other hashtags from a drop down list (up to a maximum of 3) to help other people find your look.

How will my photo and any other details submitted by me be used?

By uploading your Photo you acknowledge that it may be selected to be displayed in the Gallery on the Websites, that it may also appear on the product pages on the Website if you tag a particular product, may be seen worldwide and may be used as further described below.  ASOS will select Photos at its absolute discretion.  For the avoidance of doubt, ASOS is under no obligation to use all Photos submitted.

By uploading your Photo you retain your rights in that Photo.  By submitting a Photo you hereby grant to ASOS a perpetual irrevocable, worldwide, non-exclusive, royalty-free licence (with the right to sub-licence) to use, edit, alter, reproduce, translate, publish and/or distribute the Photos and/or incorporate it in other works on the ASOS Websites or in other products or services available through the Websites (the Websites and the products and services collectively referred to as the “Services”) using any and all media or distribution methods (now known or later developed).  You understand that this licence means your Photo may be made available by ASOS worldwide on the Services and that other users of the Services (individuals and companies) can also share and make your Photos available on social media platforms or other services.  More, particularly a user can share a Photo directly from the Gallery on Pinterest, Twitter and if they are accessing the Gallery on their mobile device to WhatsApp.  If you do not want to grant the permissions set out above then please do not submit or share your Photos.

By submitting your Photos you are warranting that you have the right to grant the licence described above.  In particular, you promise that you have obtained the permission of all the people featured in the Photo (and, if they are under 18 their parents and guardians as well) to allow ASOS and other users of the Services to use the Photos.  To the extent permitted by law, you also agree to waive your moral rights in relation to any Photos submitted.

If you upload your Photo directly to the Gallery, via the Websites, you may be asked to submit your email address which ASOS will use to contact you to let you know if your Photo is published.  The email address you submit will only be used to contact you about your Photo and will not be used for any other purpose.  ASOS’ privacy policies can be found below:

Due to the large number of submissions it will not be possible to contact individuals where their Photos are not selected to appear in the Gallery.

Depending on how you upload your Photos to the Gallery, it may provide you with the ability to interact with social media services.  These features may enable integration and/or access to your social media services, your profiles on those services or establish rules about how your personal information on those services will be used.  You and the social media providers are in control of those issues, not ASOS.  You are encouraged to read all policies and information on the applicable social media services to learn more about how they handle your information before using any such features.  We are not responsible for any acts or omissions by any social media service provider or your use of features that come from their platform.

What shouldn’t I upload to the Gallery?

ASOS moderates all photos before they are submitted to the Gallery but to help our moderators please keep in mind the following:

Copyrighted/trade marked material: please don’t upload any Photos or other content that infringes or might infringe the rights (e.g. copyright or trade marks) of a third party (such as content that contains any third party content like, trade marks, logos, insignia, photographs or art work/graphics).

Bullying: The Gallery is about having fun... Let's keep anything that's harmful, threatening or violent, harassing, abusive, offensive, hateful, inflammatory, discriminatory, profane or considered to be bullying out.

Impersonation: Please keep any account usernames used to upload Photos clean and don't impersonate anyone.

Private and confidential material: The Gallery is all about fashion so don't post anything that would be considered confidential or private or anything that you wouldn't be comfortable with a complete stranger seeing (like work info, credit card numbers or home addresses or any intimate photos/videos or photos/videos taken without the subject’s consent).

Graphic Content: Keep it clean! Don’t post any obscene, indecent or sexually explicit Photos or other content.

Lies: Make sure any comments accompanying your Photos are accurate (where they include facts) and are your genuinely held opinions (where you are giving your opinion). Don’t post anything which is any way defamatory of any person or company.

Advertising: Please don’t advertise or promote third parties’ or your own goods or services in any Photos or submissions.

Linking to bad stuff: Don't link to any media or executable file with your Photos or submissions. If you think someone has posted one, don't click on it but report it to us. If you click on it, you run the risk of getting a virus on your computer. Remember that ASOS.com is not responsible for third-party sites.

What happens if I have a complaint about a Photo or want my Photo removed?

If you believe a Photo on the Gallery is inappropriate, offensive or is violating someone’s legal rights (for example, copyright or trademark infringement) then you can report the Photo by sending an email to reportimage@asos.com.  Once an email report is received, ASOS will remove the Photo in question whilst they investigate further.

Please note that whilst ASOS can remove photos from: the Gallery, the Websites, Services or any other website under ASOS’ reasonable control, ASOS is not able, nor is ASOS responsible for, the removal of photos shared or posted by third parties on third party sites (including but not limited to social media sites) which are not under ASOS’ control.  If you wish to report a photo shared on a third party site, you should contact the third party or third party site directly.

ASOS will remove any Photos and/or content that may put ASOS or our agents at legal risk, such as potentially libellous or defamatory comments, or Photos posted in potential breach of copyright or other third party rights.  ASOS or its agents reserve the right, in their sole discretion, to remove any Photos or comments at any time without specifying the reason(s) for doing so or without entering into further correspondence.
